Ken has over 25 years of experience serving as the lead counsel, in various types of commercial real estate transactions, on behalf of developers, users and lenders, including acquisitions, portfolio sales, bankruptcy dispositions, ground leases, joint development agreements, and construction contracts and the accompanying debt and equity financings. The projects have included mixed-use developments, office parks, condominiums, apartment complexes, shopping centers, and offshore resorts, ranging in size from the very small to almost 2 billion. His clients have included Verizon, Wachovia Bank, Wells Fargo Bank, Prudential, Walton Street Capital, JPI, Lincoln Property Company, The Charles E. Smith Company, Hechinger Company, and numerous local and international developers. He was elected to the American College of Real Estate Lawyers, Inc. (election is based upon professional qualifications, with only 20 attorneys in D.C. having been elected to the College) and to the governing Council of the Section of Real Property, Probate and Trust Law of the American Bar Association. He has presented numerous programs before the American Bar Association and other professional organizations, and has written many articles.
During the course of those transactions, Ken successfully (a) restructured transactions to save state and local recordation and transfer taxes, including, in one instance saving almost $600,000; (b) helped a governmental agency find ways of resolving numerous inter-departmental conflicts, and complying with numerous stringent regulations, to help it sell hundreds of commercial properties; (c) revitalized negotiations, that had completely broken-off under other counsel, for the acquisition of a commercial building; and (d) drafted and lobbied for the enactment of recordation and transfer tax and municipal bond legislation that made the subject projects feasible.
